Terms of Service — serp.cheap (International)
Effective date: 15 June 2026
This version applies to customers established outside Brazil. Brazilian customers are governed by the Portuguese-language Terms (PJ or PF as applicable). The English text is the official version; translations are provided for convenience.
By accessing or using the serp.cheap service, API, dashboard, or website (collectively, the “Service”) operated by WILLIAM BITTENCOURT MORAES SOLUÇÕES EM DESENVOLVIMENTO, a company registered in Brazil under 29.785.688/0001-44, with registered address at Rua Barão de Santo Ângelo, 185, São Judas Tadeu, Gravataí - RS, CEP 94075-090 (“serp.cheap”, “we”, “us”), you (“you”, “Customer”) agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must not access or use the Service.
These Terms incorporate by reference our Privacy Policy, Acceptable Use Policy (“AUP”), and, where applicable, our Data Processing Addendum (“DPA”). Together they form the entire agreement between you and us.
1. Nature of the Service
serp.cheap provides a search-results API that returns structured data aggregated from publicly available web sources. serp.cheap is not affiliated with, endorsed by, or sponsored by Google LLC or any search engine. All trademarks, service marks, and copyrights in search results belong to their respective owners. We provide access to publicly available information; we do not claim ownership of third-party content surfaced through the Service.
2. Eligibility and Accounts
The Service is a business-to-business tool intended for use in your professional or commercial activity. You must be at least 18 years old and have legal capacity to enter into contracts. You are responsible for the security of your API key and account credentials, and for all activity that occurs under them. You agree to provide accurate registration information and to keep it current. One account per person or legal entity, unless we agree otherwise in writing.
3. Acceptable Use
Your use of the Service is subject to the AUP. In summary, you must not use the Service or any data obtained through it for any unlawful purpose, to infringe third-party rights, to circumvent technical or usage limits, or in any manner prohibited by the AUP. You are solely responsible for ensuring that your use of the Service and of the data returned complies with all laws and with the terms of any third-party source from which data originates.
4. Data License and Responsibility
Data returned through the Service may include third-party content. Responsibility for that content remains with its originators. Unless permitted by law or by the rights-holder, you agree not to: misrepresent the ownership or source of the data; remove or alter copyright, trademark, or proprietary notices; or falsify author attributions or legal notices. You are solely responsible for your storage, processing, redistribution, and commercialization of any data obtained through the Service.
5. Plans, Fees, and Payment
The Service is offered on a pay-as-you-go and/or subscription basis as described on our pricing page. Prices are stated in US dollars and are exclusive of taxes unless stated otherwise. You may obtain access (a) directly from us by credit card (processed by Stripe, Inc.), (b) directly from us by cryptocurrency, or (c) through third-party marketplaces such as RapidAPI or Apify. When you purchase or access the Service through a third-party marketplace, that marketplace’s own terms, billing, and pricing also apply to you, and we are not responsible for their acts, fees, or availability. By providing a card payment method, you authorize us (and our processors) to charge all fees incurred. Prepaid credits are consumed as you use the Service and, unless stated otherwise, are valid for twelve (12) months from purchase. Fees already paid are non-refundable except as expressly stated in these Terms or required by applicable law. We may change prices prospectively; changes do not affect credits already purchased.
Cryptocurrency payments (non-KYC). Payments made in cryptocurrency are processed on public, decentralized blockchain networks and are final and irreversible by their nature. We do not take custody of crypto funds, do not act as a financial intermediary or exchange, and do not perform identity verification (KYC) on crypto payers. Because such payments are anonymous and irreversible, there is no chargeback, reversal, refund, or dispute mechanism available for crypto payments, and you waive any such right with respect to them. You are solely responsible for the lawfulness of the funds used and for any tax, reporting, or regulatory obligation applicable to you in your jurisdiction. You agree not to use cryptocurrency payment for any unlawful purpose, including money laundering or sanctions evasion. This crypto payment flow operates independently of, and is not intermediated, custodied, or guaranteed by, the Brazilian operating entity.
6. Rate Limits and Availability
The Service is subject to per-plan rate limits, which are published and may change. We provide the Service on a best-effort, “as available” basis and do not guarantee uninterrupted or error-free operation. The Service depends on third-party sources and infrastructure outside our control; their changes may temporarily degrade or interrupt the Service. Scheduled maintenance, force majeure, and abuse mitigation may cause downtime. Any service-level commitment, if offered, applies only where expressly stated in a separate written SLA.
7. Modifications to the Service
We may add, change, suspend, or discontinue any part of the Service at our discretion. We will use reasonable efforts to give notice of material adverse changes. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
8. Suspension and Termination
We may suspend or terminate your access immediately, with or without notice, if you breach these Terms or the AUP, if required by law, or to protect the Service or third parties. You may stop using the Service at any time. Provisions that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnity) survive.
9. Disclaimer of Warranties
THE SERVICE AND ALL DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, ACCURACY, COMPLETENESS, RELIABILITY, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. We do not warrant that the data is accurate, current, complete, or fit for any purpose, or that defects will be corrected. You assume the entire risk arising out of your use of the Service and the data. No advice or information, whether oral or written, obtained from us creates any warranty not expressly stated here. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you; in that case such warranties are limited to the minimum scope and shortest duration permitted by law.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
(a) IN NO EVENT WILL serp.cheap, ITS OWNERS, OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, DATA, GOODWILL, OR ANTICIPATED SAVINGS, WHETHER OR NOT FORESEEABLE AND EVEN IF ADVISED OF THE POSSIBILITY, UNDER ANY THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE).
(b) OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (i) THE FEES YOU ACTUALLY PAID TO US FOR THE SERVICE IN THE ONE (1) MONTH IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (ii) USD 50.
(c) THE LIMITATIONS IN THIS SECTION APPLY TO THE FULLEST EXTENT PERMITTED BY LAW BUT DO NOT EXCLUDE LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW — SUCH AS LIABILITY FOR FRAUD, FRAUDULENT MISREPRESENTATION, WILLFUL MISCONDUCT, OR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE. NOTHING IN THESE TERMS LIMITS RIGHTS YOU MAY HAVE AS A CONSUMER UNDER MANDATORY LAW OF YOUR COUNTRY OF RESIDENCE THAT CANNOT BE WAIVED BY AGREEMENT.
(d) YOU AGREE THAT THE ALLOCATION OF RISK IN THIS SECTION REFLECTS THE LOW PRICE OF THE SERVICE AND IS AN ESSENTIAL BASIS OF THE BARGAIN, AND THAT THESE LIMITATIONS WILL SURVIVE AND APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
11. Indemnification
You agree to defend, indemnify, and hold us harmless from any claim, damage, loss, liability, cost, or expense (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your use, storage, or redistribution of data obtained through the Service; (c) your breach of these Terms or the AUP; or (d) your violation of any law or third-party right.
12. Governing Law and Venue
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Any dispute arising out of or relating to these Terms or the Service shall be resolved by final and binding arbitration administered on an individual basis, seated in Delaware, conducted in English. You and serp.cheap waive any right to a jury trial and to participate in a class, collective, or representative action. Either party may seek injunctive relief in a court of competent jurisdiction for infringement or misuse of intellectual property pending arbitration. This clause does not deprive a consumer of the protection of mandatory provisions of the law of their country of residence that cannot be derogated from by agreement.
13. Changes to These Terms
We may modify these Terms at any time by posting the revised version with an updated effective date. Your continued use after the changes take effect constitutes acceptance. If you do not agree, you must stop using the Service.
14. Miscellaneous
If any provision is held invalid or unenforceable, it is severed and the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
